The General Data Protection Regulations (EU 2016/679 of the European Parliament) came into force on the 25th May 2018. This European legislation is intended to give you more clarity over how your personal information is managed and safeguarded. The new rules mean all businesses, including ourselves, have to make sure you understand how we will handle your personal information and why we need to process and store it. This policy sets out what information we are holding about you and why.


“Data Controller” means Moores Estate Agents Limited.

“Data Protection Laws” means applicable legislation protecting the personal data of natural persons, including in particular the Data Protection Act 1998 and replacement to it, including GDPR (see below), together with binding guidance and codes of practice issued from time to time by relevant supervisory authorities.

“GDPR” means Regulation (EU) 2016/679 of the European Parliament and the Council of 27th April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data including where applicable any local implementing laws as updated from time to time.

“Services” means any service or action which is conducted by Moores Estate Agents in accordance with its business procedures and practices on behalf of customers.

“Customers” means any buyer, seller, tenant, landlord, contractor or supplier of Moores Estate Agents.


From 25th May 2018 Moores Estate Agents will:

a. Process personal information provided to us solely for the purposes of our estate agency business in delivering good customer service. We hold data on the legal basis of ‘Legitimate Interest”

b. Process only the type of personal data required for us to fulfil our objectives and legal obligations. This is likely but not exclusively to include the following:-

i. Name and correspondence address

ii. Phone numbers and email addresses for good communication

iii. Financial information if you are a buyer

iv. Income, employment and credit details if you are a tenant

v. Proof of Identity including details on passports, driving licences, utility bills, bank or credit card statements, etc

vi. Bank account details for landlords, tenants and contractors

vii. Ages of any dependent children in the case of renting a property

c. Take all measures required by Article 32 of the GDPR to ensure the security of your data

d. Take reasonable steps to ensure the reliability of any staff who may have access to your data and treat your data as personal and confidential

e. Not transfer your personal data out of the European Economic Area (EEA) in accordance with the GDPR requirements without your prior express consent

f. Not permit any third party to process your personal data without your prior express consent except in the case of our compliance with

i. the Money Laundering Regulations

ii. the Proceeds of Crime legislation

iii. Inland Revenue reporting requirements

g. Promptly, and in any case within 48 hours of our becoming aware, notify you of any data breach, such notice to include all information we are aware as being part of the breach to enable you to take reasonable steps to safeguard you

h. Enable you to object to how we process your personal information and for you to have the right to:

i. Access

ii. Amend

iii. Correct

iv. Sometimes delete

v. Sometimes restrict the personal information we use. A fee will apply for multiple requests.

Before disclosing the information, proof of identity will be required.

i. Provide you with details of how to complain to us and to the Data Protection Regulator upon request

j. Retain your personal information for as long as we need to for the purposes described above, or no longer than 7 years to comply with statutory UK financial legislation


From March 2020, there is a requirement for us to process Special Category personal data during the COVID-19/Coronavirus pandemic.

We process the Coronavirus status of our staff, tenants, contractors, landlords, vendors, buyers, prospective tenants and applicants wishing to view properties. Questions asked to them are below, and the answers to the questions are therefore processed by Moores Estate Agents.

  • Do they have any symptoms of coronavirus
  • Does anyone in their household have any symptoms of coronavirus
  • Has anyone in their household been in contact with someone who has tested positive for coronavirus
  • Are they self-isolating at present or within the last 14 days
  • Are they classed as vulnerable and therefore are shielding

The basis for Moores Estate Agents processing this data is Safeguarding Health under:

DPA 2018 Schedule 1 Part 1 (2)(2)(B) the assessment of the working capacity of an employee

DPA 2018 Schedule 1 Part 1 (3) Public Health

It is relevant to keep the Special Category data for the length of the Coronavirus pandemic. The data will be periodically reviewed and may be erased where deemed necessary, including but not limited to:

  • A viewer who has found a property not with Moores Estate Agents
  • A tenant who has vacated a property
  • A contractor who is no longer symptomatic
